Step 1: Both Spouses Must Be Ready
Mutual divorce in India is filed under Section 13B of the Hindu Marriage Act, 1955. Both parties must agree:
- That the marriage has irretrievably broken down
- That they’ve lived separately for at least one year (physically or emotionally)
- And that they want the divorce without blaming each other
If one of you is still unsure, we can work through that — we often help couples reflect before they rush to court.
Step 2: Engage a Lawyer Who Handles It All — Legally and Emotionally
This is where your choice of lawyer changes everything. If you’re looking for someone who will:
- Handle your petition discreetly
- Structure your terms clearly (custody, assets, alimony)
- Waive the cooling-off period (where legally possible)
- Respect your privacy, especially if you’re a public figure
- File everything correctly in Chennai Family Court

Step 3: Drafting the Mutual Divorce Petition
A joint petition is prepared stating:
- Both parties consent to divorce
- Separation period of minimum one year
- Mutual agreement on maintenance, custody (if any), and assets

- We reduce scope for confusion or regret later
- We protect both legal and emotional dignity
Step 4: Filing the Petition in Chennai Family Court
We file the petition in the court that has jurisdiction based on any of the following:
- Place of marriage
- Place of last matrimonial residence
- Current residence of either spouse

Step 5: First Motion Hearing

Step 6: Cooling-Off Period (6 Months — Can Be Waived)
Legally, there’s a 6-month waiting period between the first and second motions. But we help you apply for waiver if:
- You’ve lived separately more than 18 months already
- The marriage is clearly irreparable
- Both parties genuinely want closure
Courts in Chennai do grant waivers in well-drafted cases. We help you prepare a strong waiver application.
Step 7: Final Hearing and Divorce Decree
After the second motion, the court passes the final Mutual Divorce Decree. This officially dissolves the marriage. You walk away with legal closure — without emotional destruction.
